In a new ruling, a North Carolina judge has decided on the preliminary injunction request from Legacy Motor Club. LMC is taking Rick Ware Racing to court over a NASCAR charter dispute. Another lawsuit in the Cup Series.
Legacy Motor Club and Rick Ware Racing have been at it for a few months now. Legacy says RWR agreed to sell a charter to them for 2026. RWR was under the impression that it wasn’t until 2027. Now, Ware is trying to sell off his entire operation to former Spire Motorsports owner TJ Puchyr.
Today, the court ruled in favor of Legacy. There is now a preliminary injunction preventing the sale of any charters from Rick Ware Racing while this litigation is ongoing. A trial date is set for January at this time.
Bob Pockrass of FOX Sports reported the details. Sounds like Rick Ware is in a tough spot.
Rick Ware Racing is not allowed to transfer or sell either charter that it owns. Currently, one of the charters is being leased by RFK Racing. That is Ryan Preece’s ride this season. RWR is also barred from completing the deal with Puchyr.
It also appears that the courts want RWR to avoid “encumbering” the charters in excess of $25 million. Should Legacy Motor Club win out in litigation, RWR must deliver one of its charters to them without any extra encumbrances.
Legacy Motor Club wants to expand quickly
There is a desire and an urgency from Legacy Motor Club to expand its operations in the NASCAR Cup Series. That starts with adding a third charter. It appears that the magic number is three when it comes to balancing performance with resources.
Jimmie Johnson is now the majority owner in Legacy. He is also a major part of pulling down sponsorship and funding for the organization. By racing a few times per year, it adds an extra element and return on investment for sponsors.
Rick Ware Racing appears to be in a tough spot. There is an agreement that was signed by both sides, which has been called into question, but now it is for a court to decide.
As this case continues, it could shape the 2026 season. Depending on where these charters end up could change the drivers in the field for next year. It could even determine whether Corey Heim goes Cup racing or not.
