Badgers cornerback Nyzier Fourqurean submitted an amended complaint against the governing body of college athletics on July 31.
MADISON – While Nzyier Fourqurean continues to wait for word on the appeal the University of Wisconsin filed on his behalf with the NCAA, he and his legal team made another move in his fight to play college football this season.
On July 31, Fourqurean filed an amended complaint in the District Court for the Western District of Wisconsin that seeks declaratory, injunctive and monetary relief against the NCAA for its rules related to how many years a student-athlete is eligible to play NCAA Division I football.
The filing comes in response to the Seventh Circuit Court of Appeals decision to lift the preliminary injunction Fourqurean received in February that allowed him to compete for UW this season.
With the injunction lifted, Fourqurean is ineligible to play for Wisconsin unless the NCAA grants the appeal the university filed on July 22 or he wins this case. He has been practicing with the team despite his uncertain status.
According to the amended complaint Fourqurean seeks “declaratory, injunctive and monetary relief against the NCAA, an end to unjustified anticompetitive restrictions on participants in the NCAA Division I football marketplace and to restore the freedom to seek economic opportunity for Fourqurean and other similarly-situated NCAA Division I college football players.”
The case is slated to be heard by Judge William Conley. Conley granted Fourqurean the preliminary injunction. The trial is set for Sept. 29.
The Badgers will have played four games at that point in the season.
Fourqurean's issue with the NCAA started in January when he appealed for an additional year of eligibility. He cited the mental and emotional hardship he faced during the 2021 season when he played sparingly as he mourned the loss of his father.
The NCAA's decision led him to seek relief from the courts.
In the latest filing it states if Fourqurean is not granted an additional year of eligibility his playing opportunities would be limited due to his decision to forgo the NFL draft after the district court granted his preliminary injunction.
